Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Photon AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Gryntix ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance.

2. Description of Service

Photon AI is a mobile application available on Android that provides access to AI-powered conversational capabilities. The App connects to third-party AI model APIs to generate responses to your queries. Features may include text chat, image analysis, and file processing, depending on your subscription tier.

3. Account Registration

To access certain features (including subscriptions and purchase tracking), you must create an account using a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and current information

You must be at least 13 years of age to create an account.

4. Subscriptions and Purchases

4.1 Billing

Photon AI offers both free and paid subscription tiers. Paid subscriptions are billed through Google Play in accordance with Google Play's billing policies. By subscribing, you authorize recurring charges to your payment method.

4.2 Cancellation

You may cancel your subscription at any time through Google Play settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for the remaining period unless required by law.

4.3 Price Changes

We reserve the right to change subscription prices. You will be notified of price changes at least 30 days in advance. Continued use after the price change date constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use Photon AI to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any applicable local, national, or international law or regulation
• Infringe the intellectual property rights of any third party
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated means to access the App in a manner that exceeds normal usage
• Transmit viruses, malware, or other harmful code
• Generate, distribute, or store child sexual abuse material (CSAM) or any content that exploits minors

We reserve the right to terminate your account immediately for violations of this section.

6. AI-Generated Content

Photon AI uses third-party AI models to generate responses. You acknowledge that:

• AI-generated content may not always be accurate, complete, or up-to-date
• You should not rely solely on AI-generated content for medical, legal, financial, or other professional advice
• You are responsible for how you use and act upon AI-generated content
• Content generated may be subject to the terms of the underlying AI model providers

7. Intellectual Property

The Photon AI app, including its design, code, branding, and content created by Gryntix, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of content you input into the App. By using the App, you grant Gryntix a limited license to process your inputs solely for the purpose of providing the service.

8. Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Gryntix does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, Gryntix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

10. Termination

You may stop using the App at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or courts of competent jurisdiction.
